Representation agreements work, but the lack of education in all sectors (law, health, finance, government, community) can be frustrating and an additional burden for those who support a spouse, family member or friend. The adult and the witnesses must sign at the same time. Other people named in the agreement have documents to sign, but do not need witnesses and can sign at a later date and at different times. Effective September 1, 2011, amendments were made to the Representation Agreements Act, the Power of Attorney Act and the Health Care Consent and Admission to Care Facilities Act. These changes have brought certainty and complexity. This makes education very difficult. We also see more confusion and misinformation. Agreements concluded BEFORE 1. As of September 2011, these restrictions were not taking place and the changes indicate that these agreements may remain in effect and are NOT affected by the restrictions. The RA Act outlines three roles. A representative is required, other roles are optional.
If you entered into a valid representation contract before September 1, 2011, it is still valid – you will not only have to enter into a new contract due to the changes. Do NOT send documents to Nidus. The registry is online so you can do it yourself. The powers of a representative are listed in two different parts of the RA Act, called sections – section 7 and section 9. The different types of agreements became known as RA7 and RA9. “My mother was 91 years old and was in the hospital and could not get her informed consent at the time. I said, “NO, she doesn`t want that.” They said, “You can`t make that decision.” I said, “YES, I do,” and withdrew the representation agreement that my mother had made. He designates me as the representative. This traditional standard goes back hundreds of years.
It leaves out many citizens whose ability to meet this traditional standard can be affected by disability, illness or injury. For example: It authorizes one or more people to help an adult make decisions (sometimes called assisted decision-making) or to act on behalf of the adult (sometimes called a substitute decision). One of the purposes of the representation agreements was to ensure that people died with dignity. A representation agreement is an essential document for the quality of life until the end of life. Abusing and neglecting seniorsPlanning your future when an adult is unable to have a representation agreement is the only way to allow someone – called your representative – to help you or act on your behalf for health and personal care issues. Some might use a representation agreement to cover day-to-day financial and legal matters.
Unfortunately, ar law has never been properly implemented. No government has funded education. While the above statement may seem obvious to those who have experience with it, it is not always reflected in the policies and practices of service systems and institutions. Some changes to a representation agreement do not invalidate the agreement. Other types of changes require the revocation (termination) of the existing agreement and the conclusion of a new agreement.
